Yes, a foreigner can buy a house in Spain without the need for residency or nationality. You will only need a Foreigner Identification Number (NIE), which is used for any legal and fiscal formalities related to the property. In addition, you will be able to open a bank account in Spain to make payments and cover taxes and expenses associated with the purchase.
Both Spaniards and foreigners pay the same tax when purchasing land or a property in Spain. This is a percentage of the purchase price, which varies depending on the autonomous community. For example, in the Valencian Community it is 10%, while in the Region of Murcia it is 7.75%.
There are special cases: if the seller is a trader or professional, a 21% may apply in certain cases. Reduced rates are also provided for in specific circumstances.
In our case, the client pays the corresponding tax when acquiring the land as indicated. Once the property is completed, the tax is paid when the deed is executed: it will be 1.5% of the construction price if the property is intended as a second home, or 0.1% if it is a primary residence.
